Bus driver suspended

According to the Ledger-Independent, a  Fleming County School bus driver was suspended last month after she purposely swerved the school bus she was driving at another vehicle.
The driver, Ellen Brooks, returned to work after a five-day unpaid suspension and completion of six hours of training under the supervision of the school district's interim Director of Transportation, according to superintendent Kelley Crain . The swerve, which occurred Sept. 12, was apparently a salutation from Brooks to someone she knew.
"She was traveling in a school bus when an oncoming vehicle swerved at her, as to say hello, and she swerved at them, as to say hello," Crain said."She swerved her bus in an unsafe manor to communicate to a friend."
The swerve came to the school district's attention when a concerned citizen called in.

An investigation was subsequently launched that included interviews with the driver and the witness, a review of audio and video recordings from the bus and a study of transportation laws and policies. Crain said the investigation confirmed the incident did occur and she felt disciplinary action was appropriate. She said Brooks was ultimately suspended for neglect of duty, violation of local transportation policies and state regulations, and misconduct.
Crain said bus safety is "absolutely" a priority for Fleming County Schools.

Transportation crews mobilize to combat ice

Cabinet urges motorists to monitor conditions, use extra caution

FRANKFORT, Ky. (Dec. 15, 2008) — Transportation Cabinet crews in western Kentucky have mobilized snow and ice forces to combat wintry weather that threatens to make driving conditions hazardous. Crews statewide are monitoring pavement conditions as the weather maker advances across the state.

“Our crews are prepared to work around the clock to keep roads in the best possible condition,” said Transportation Secretary Joe Prather. “We advise motorists to pay close attention to developing conditions and to try to avoid driving when roads get treacherous.”

National Weather Service forecasts indicate that Kentucky could receive a one-two punch, with rain today changing to freezing precipitation, beginning in western Kentucky. Another band of freezing rain is expected into Tuesday. Cabinet officials are also concerned with the rapidly declining temperature, which could freeze wet pavement.

As temperatures drop to the freezing point, crews are applying rock salt to the pavement to help prevent ice development.

Road conditions are described by these terms:

Wet Pavement – The roadway is wet. Ice could form as temperatures drop.

Partly Covered – The roadway is partly covered with snow, slush or ice.  Markings may be obscured.

Mostly Covered – The roadway is mostly covered with snow, slush or ice. Roadway markers may be difficult to see because of packed snow and rutting conditions.

Completely Covered – The roadway is completely covered with snow, slush or ice and markings are obscured.

Impassable – Roadway conditions are not suitable for travel unless required by an emergency.

The latest road and weather conditions are available online at 511.ky.gov or by dialing 511.

KYTC road crews treating for snow and ice

FLEMINGSBURG, Ky. – Kentucky Transportation Cabinet (KYTC) road crews in Department of Highways District 9 are treating roadways in northeast Kentucky as freezing rain continues to fall across the region.

Salt truck crews are out, and are expected to remain out overnight, in Bath, Boyd, Carter, Elliott, Fleming, Greenup, Lewis, Mason, Nicholas and Rowan counties.

Roadways are wet, and ice could form as temperatures drop into the mid-20s. National Weather Service forecasts call for continued precipitation, including snow. Motorists are advised to drive carefully, allowing plenty of time to get to destinations.

Other driving tips include:

  • Slow down, and remember that bridges and exit and entrance ramps can be icy when other areas are not.
  • Leave enough room between you and the car in front of you because stopping in snow may require up to four times your normal stopping distance.
  • If you skid, stay calm and ease your foot off the gas while carefully steering in the direction you want the front of your vehicle to go.

Road condition reports in Kentucky are available by calling 511 or by logging on to the 511 travel and traffic information Web site at http://511.ky.gov.

In District 9, crews are prepared to clear a path through snow and ice on more than 2,000 miles of roadways whenever winter weather is predicted with 75 trucks and operators, about 15,000 tons of salt, and tens of thousands of gallons of salt brine and liquid calcium. More information is available online at transportation.ky.gov/d9/Snow.htm.

Motorists are reminded to share the road with KYTC equipment, and always buckle up and Drive Smart. Kentucky’s Snow and Ice Treatment Map is available online at http://kytcgis.ky.gov/snow_ice.

Puckett trial is April 2009

According to the Ledger Independent, a two-day jury trial is scheduled to begin April 20, 2009 in the case of a Flemingsburg man accused of taking more than $2,000 in donations intended for Feed God's Children, a charity he operated with his wife.
Gerald E. Puckett, 52, was indicted in January on two counts of diversion of charitable gaming funds and faces one to five years in prison on each count if convicted. The indictment, alleging he used money intended for charity to pay personal expenses for himself and his wife, came just as Puckett launched a campaign to unseat incumbent Fourth District Rep. Geoff Davis in the Republican primary.
Puckett's wife, Joanne B. Colgan, 52, was also indicted in January on two counts of complicity to diversion of charitable gaming funds. Colgan, however, reached an agreement with the commonwealth that will allow her to avoid jail time, providing she testifies against her husband.
Colgan entered a guilty plea to both counts of her indictment on Sept. 10 and the commonwealth recommended a sentence of four years on each count to be served consecutively. Court documents indicate the commonwealth also agreed to a three-year supervised diversion, which is similar to probation.
In addition to providing "truthful testimony" in Puckett's trial, Colgan must not "serve as an officer or organizer, fund-raiser or member of any charitable organization" and she will be responsible for paying half of $2,115.96 sought for restitution. The court has determined restitution will be divided equally between two licensed charitable organizations in Fleming County, the Cancer Care Club and VFW Post 1834.
Colgan is expected to appear for a Dec. 5 status hearing in Fleming Circuit Court.
Puckett and Colgan were reportedly co-chairs of Feed God's Children, Inc., which shared a mailing address with Kentucky Charities United, Inc. Both organizations are specifically named in the second count of Colgan and Puckett's indictments, with the commonwealth alleging Puckett "diverted funds from a legitimate charitable purpose or lawful expense to his financial benefit by transferring charitable gaming funds from Kentucky Charities United, Inc. to Feed God's Children, Inc. to pay personal expenses for himself and/or his spouse" between Oct. 24, 2006 and Nov. 16, 2006.
Count one of each indictment alleges Puckett "failed to deposit proceeds from bingo and pull-tabs, and kept the profit for himself and/or his spouse" between Oct. 22, 2006 and Nov. 26, 2006.
Records show Feed God's Children, Inc. has been in operation since at least 2002 and periodically held bingo games at a Flemingsburg bowling alley. Those games have ceased. Prior to indictment, the charges were investigated by the Kentucky Department of Charitable Gaming.

Ellison awarded $230,000

According to the Ledger Independent, a Fleming County jury awarded a Ewing woman more than $230,000 Friday for an incident at a Little League tournament in 2005.
"I'm happy," said the former Ewing mayor Nellie Ellison, who suffered serious facial trauma requiring reconstructive surgery and permanent nerve damage after the altercation with former Fleming County Little League president Andrew Jones.
Nellie Ellison's trial attorney, Chauncey Hiestand, felt the jury's decision to award his client $60,298.89 in compensation for past medical bills, $20,000 for past and future pain and suffering and $150,000 in punitive damages sent a strong message to Jones and the community.
"I think (the jury) spoke, and they said 'In Fleming County, these types of actions will not stand,'" Hiestand said.
Nellie Ellison's civil suit asked for the $60,298.89 in past medical damages that Jones had already agreed he should pay, as well as up to $110,000 for pain and suffering and up to $1.1 million in punitive damages. Punitive damages may be ordered by a jury in civil trials as a means of punishing the defendant and/or deterring the defendant and others in the community from committing similar acts.

The awards for past medical expenses and pain and suffering were unanimous, but the decision to award punitive damages was endorsed by only nine of the 12 jurors. Civil trials require only nine of 12 jurors to agree on a verdict.
Jones has already pleaded guilty to first degree wanton endangerment in criminal court in relation to the case.

Jeff Burke suspension is over

By Danetta Barker

Editor

The saga of Jeff Burke’s suspension from his position as assistant superintendent is over and he will not be reinstated in that position.

According to Superintendent Kelley Crain, an administrative tribunal has issued a report detailing the charges made against Burke. The findings state that he must be offered a position within the school system and must accept that position in the 2009-2010 school years.

The process had been long and Crain has been required by law not to release any information. Now that the issue is resolved Crain can better explain the events that lead to Burke’s suspension.

“On April 21, 2008, I issued a press release regarding Jeff Burke’s employment status with the Fleming County Schools, and I have been legally constrained since that time from offering any additional details.  Mr. Burke exercised his statutory right to an administrative hearing before a neutral, three-member panel. To my knowledge the administrative decision is now final and is part of the public record. I am now able to give some additional details regarding this employment matter,” Crain said in a press release.

Crain had suspended Burke with pay March 27, 2008 after a urine test came back showing Burke had used cocaine. According to the report from the tribunal the final result of Burke’s test was 7500 ng/mL, the cutoff for being out of range is 100ng/mL.

The report also stated that Burke’s name had been pulled at random for testing, as is the policy to test those working in the transportation department of the school district. Burke served as director of transportation as well as finance officer. Burke tried to get an alternate for the test, which is allowed should the person be unable to test the day his or her name is pulled. Burke, who had been going through a difficult divorce, said he was on his way to a lawyer’s office in Mt. Sterling. He tried to get Crain to let him have an alternate. She denied his request. Burke’s name had been drawn Oct. 24, 2007 and Dec. 3, 2007, and both times he was allowed not to be tested. Burke was given three hours to test on March 27.

After Crain suspended Burke with pay for the preliminary results of the test, he told her the final result would prove he had nothing improper in his system. That was not the case.

Crain offered Burke another position within the school system, but he declined the offer.

“Before deciding to terminate Mr. Burke’s employment, I made an offer to Mr. Burke which would have permitted him to remain employed in a different position while seeking drug treatment and counseling and submitting to drug testing beyond that required by regulation and Board policy. The drug testing and counseling requirements were included in the proposed agreement after considerable consultation by myself with professionals from the respective fields, and were intended to ensure student and employee safety,” Crain said. “Mr. Burke rejected this offer and refused to relinquish his administrative position.  A position which was highly safety sensitive in nature, and required administration of the transportation program and oversight of finances.  As a result, I felt Mr. Burke left me no choice but to seek his termination from these positions. The statutory process for certified school employees makes my action a mere recommendation, and leaves the final decision to a three-member tribunal panel appointed by the Commissioner of Education.”

The formal charges against Burke were conduct unbecoming a teacher. Burke was charged for not submitting sick leave cards or requested non-contract leave days on up to 25 dates during the 2007-08 school year. Burke was in charge of employee leave cards. The tribunal found there were days when there was no evidence that Burke was performing duties for the district and he had not indicated they were non-pay or sick days.

Burke was also charged for not taking appropriate measures to keep the central office apprised of his whereabouts. As transportation director, it was Burke’s job in bad weather to inspect roads, call school off and notify the media.

Although Crain had trouble contacting Burke during inclement weather the tribunal found there was not sufficient evidence to convince them that Burke had not acted in timely manner.

Another charge was of not submitting evaluations on employees. Burke said he had hand written the evaluations but had been suspended before he could give the information to Crain.

On the charge that Burke failed to provide information as requested in regard to a nickel tax increase for the district and the effect on bonding potential for presentation to the Board of Education it was found that Burke did not provide the information as requested.

The last charge of the use of profanity in the office was found by the tribunal to be correct. Burke was said to have used profanity and name calling on two occasions.

According to Crain, Burke was appropriately suspended without pay since April 21, 2008.

“They determined Mr. Burke’s conduct relating to drug use was ‘deeply disturbing and wrong’ and that it constituted ‘conduct unbecoming a teacher.’ In light of this finding, the tribunal agreed that Mr. Burke was appropriately suspended without pay since April 21, 2008. He remains on that status pending the availability of a non-administrative position for which he holds proper certification. No such certified positions are currently vacant. The tribunal also agreed that Mr. Burke should not serve in the finance or transportation departments of the Fleming County Schools or hold a CDL to drive a school bus for the school district. Mr. Burke is also required to undergo drug counseling for two years and to submit to extra drug testing at his own expense for the remainder of his employment with the Fleming County Schools,” she said. “The conditions imposed by the tribunal members on Mr. Burke’s continued employment in the Fleming County Schools are largely the same as those offered by me and rejected by Mr. Burke on April 21, 2008. Had Mr. Burke accepted my offer, and successfully met the conditions of the offer, his unpaid suspension would have ended in June 2008, and he would have received a pay check from the beginning of the current school year to the present, and he could have spared this school district community the stress and expense of the tribunal proceeding. I appreciate Mr. Burke’s continued willingness and desire to utilize his talents for the benefit of the students of Fleming County in another capacity. I am satisfied with the outcome of the tribunal proceeding, and I look forward to putting this matter behind the school district so all of our efforts can be concentrated on continuing improvements of instructional programs and services for students.  During this entire period I have been mindful of the need to keep the entire Fleming County Schools’ team focus on our students and continue to strive to make decisions that are in the best interest of our students.”

Burke case nearing closure

According to the Ledger Independent, the case of former Fleming County Assistant Superintendent Jeff Burke's termination in April is nearing closure with the completion of a tribunal hearing in October.
The hearing, which was scheduled for Oct. 9 and 10, was the result of Burke's employment contract being terminated on April 21, 2008, 17 working days after he was placed on paid administrative leave for undisclosed reasons on March 27, 2008.
The tribunal concluded its findings on Oct. 21 and the decision was in the hands of both parties by Oct. 22.
Burke’s attorney said during an interview that "the tribunal did not uphold his (Burke's) discharge," and "they did not terminate his contract," but because there is an option for either party to file an appeal in Fleming Circuit Court, the matter is "not yet completely final."
The school board attorney said there's "not any action (being) contemplated by the district or superintendent (in regard to the appeal process) at this time."

When asked about Burke's status as an employee of the district, the school board attorney  said Burke has not been on the district's payroll since the termination of his contract in April.

Aleechawa Wells acquitted

Reminded that Americans have always had the right to defend themselves and their homes, a Fleming County jury found a woman accused of shooting at sheriff’s deputies not guilty of all five wanton endangerment charges.

Aleechawa Wells, who was charged with shooting at three Fleming Sheriff’s deputies in an incident that took place Feb. 28, 2008, took the stand in her own defense during the one-day trial Nov. 5. Represented by Gatewood Galbraith, Wells was the last witness to tell a version of the story that started with a friend alerting law enforcement officers of Wells’ condition.

“I heard a truck come through the house. It woke me up,” Wells said. “I thought it was the Mexicans. I fell out of bed and fumbled for Tommy D. I was hurt. I was trying to find my way to where the truck came through the house.” Tommy D is the name Wells gave the Super Black Hawk Ruger .44 Magnum pistol she kept in her bedroom.

There was no truck that morning just before 10 o’clock. The sound Wells heard was probably the back door of her home being kicked in.

According to testimony from Deputy Gary Kinder he had received a call from Frances “Pooch” Kissick who said he had been trying to contact Wells for several days. Kissick was afraid Wells was hurt or overdosed. He told authorities he and Wells were boyfriend and girlfriend and he had not talked to her for several days. Kinder and Kissick went to Well’s home in Wallingford.

When Kinder arrived he said Melissa Miller and her son Ryan were already there.

“They were banging on the windows and doors,” Kinder said.

When one of them pulled a 2x4 to break in a window, Kinder said he stopped them. He felt going in through the door would cause less damage to the home. Before Kinder kicked in the door he asked Kissick again if there was a chance that Wells was inside and unable to come to the door because she was hurt or sick. Kissick said yes. With that the deputy, who has made several welfare checks on residents, kicked in the door.

Kinder also testified that throughout the incident he had identified himself as a deputy with the Fleming County Sheriff’s Office. Deputy Robert Orem came for backup and said that he too had made his identity known to Wells.

Galbraith, however, reminded the deputies that lately home invasions were taking place all over the country with men claiming to be police, breaking in the home then stealing, beating and even raping the residents.

Galbraith used the home invasion stories throughout the trial. He said Wells had been victimized once by Mexican and was suffering from a flashback of those memories. Wells testified that she never shot at anyone except the Mexicans that morning.

Kinder and Orem testified that Wells had said she would shoot all the Mexicans if they didn’t leave the home. At the time of the shooting Deputy Jared Wagner was at the home and took cover from his vehicle, according to testimony.

Wells suffers from polio according to the testimony she gave. She takes several medications for pain and to help her sleep, including topomax and morphine. That morning around 7 a.m. she said she took sleeping pills and pain pills then went to bed. Less than three hours later Miller arrived and Kissick followed with deputies close behind. Once the door was opened Kissick and Miller ran into the home, according to Kinder. Both came back quickly after finding Wells with the gun. Kinder said he and Orem stood by the back door trying to get Wells to put the gun down. She fired a shot and both men ran out the door and off the porch. Kinder said Wells came out to the porch, dropped to her knees and fired another shot.

Kentucky State Police Trooper Michael Fogelman was on the scene by this time. He talked to Wells on her cell phone, which she called a “baby phone,” and asked her to come out of the house. Wells surrendered to Fogelman and was arrested.

While Galbraith argued that Wells was not fully conscious due to medications, Kinder testified that she talked coherently during an interview at the sheriff’s office.

On November 4, citizens all over the United States will be going to polling places to cast their ballots in one of the most important elections in many years. It is both a right and a responsibility for each of us to participate in this process. Choosing our leaders, whether on the national, state, or local level demands careful, serious consideration. We should make every effort to be informed about the candidates and then vote for those we believe are best qualified to provide the leadership that we deserve. As a candidate for the City Council of Flemingsburg, I am committed to addressing quality of life issues in our community which include economic, environmental, health, and recreation concerns. If elected I will endeavor to work with each of you to solve our community’s problems and ensure the brightest possible future for us all. I urge each of you to cast your ballot on November 4 for the candidate of your choice in each of the races. Thank you for your support.

Drug bust nets marijuana

According to the Maysville Ledger Independent, the Fleming County Sheriff's Office, Flemingsburg Police Department, Mason County Sheriff's Office and agents with the Buffalo Trace/Gateway Area Narcotics Task Force arrested 60-year-old Robert Filvey at his home on U.S. 68 in Fairview after an investigation conducted over more than two months for allegedly cultivating and trafficking in marijuana.
According to Fleming County Sheriff Scotty Royse, the drug bust and weapons seizure took place around 5 p.m., Monday after a search warrant for Filvey's residence was executed.
Royse said complaints about firearms being discharged in the area had been reported to his office, with some of the reports alleging an automatic weapon was being fired.
According to an agent with the task force, three pounds of "high quality" processed marijuana was seized, as well as some newly planted marijuana plants from two "grow rooms" in the basement of Filvey's home. The agent said the marijuana has a street value of $6,000. Also seized during the search were several narcotics, including Xanax, Loratab and Morphine, in quantities of 100 or more, the agent said.

Head Start bus driver suspended

According to the Maysville Ledger Independent, officials with the Licking Valley Head Start program have suspended a bus driver after a 4-year-old child was left on a bus Tuesday morning.
Licking Valley Executive Director Judy Planck, and Toby Miller, director of the Licking Valley Head Start Program, confirmed the girl was found on the bus by personnel of Cheap's Chevrolet in Flemingsburg between 8;30 a.m. and 9 a.m. The bus was at the dealership for regular maintenance service when the child was discovered.
Miller said children are dropped off at the Head Start facility on High Street by 8:30 a.m., and she was at the garage with the child before 9 a.m.
Miller said the parents of the child came to the Head Start location and took the child home with them. "We think the child fell asleep, " Planck said, noting the state day care licensing agency, and the Department of Community Based Services, both entities of the Cabinet for Family and Children Services, have been notified about the incident.
Miller also confirmed all agencies involved in the regulation of Head Start programs and day care facilities were notified immediately.
Bus drivers are required to walk the center isle of the bus and then call into the agencies to say it was cleared, Miller said. The buses do not have video cameras on them.
Miller said when questioned about clearing the bus after the morning route, Blythe told her she did not see the child anywhere. The bus monitor on Blythe's bus was assisting a special needs child when the children left the bus and was unable to help Blythe clear the bus, Miller said.

Lowell Denton Obit

- Lowell Osborne Denton, 85, former owner and publisher of the Flemingsburg Gazette for almost 48 years, died on Wednesday, Oct. 15, 2008.
He was born Aug. 11, 1923 in Fleming County, a son of the late Raymond and Edith Denton of Hillsboro.
As 1940 graduate of Fleming County High School, he received a degree in agriculture from the University of Kentucky in 1949, and was a member of Alpha Gamma Rho and Omicron Delta Kappa. He taught agriculture at Fleming County High School for two years.
His military service included three years in the United States Army. He was stationed in England and Germany with a tank destroyer battalion, attached to the First Army.
Lowell married Jean Lawson Rankin on Nov. 24, 1949 and they purchased the Fleming Gazette, as it was known then, from Ransom Todd in 1951. He saw the newspaper business change in many ways but the most striking evolution occurred in technology as linotype machines and typewriters were replaced by computers. However, he remained loyal to his manual typewriter, at which he wrote his weekly column, "From the Publisher's Pen." They sold the newspaper in 1998.
A three term member of the city council, he was actively involved in bringing the Randall Company and U.S. Shoe into Flemingsburg, was one of several to organize the local Chamber of Commerce in 1963, and helped plan the Chamber's first Friendship Night. Other civic duties included a stint as chairman of the area Red Cross and past president of the local Lions Club. He was a long-time member of the Kentucky Press Association, a former Sunday school teacher and member of the Flemingsburg United Methodist Church.

Throughout most of his adult life, his passion and foremost hobby remained the game of golf. He was a proud charter member on the board of directors who formed the Fleming County Golf Association in 1965. Until his health declined, he rarely missed a day at the course to play a round, practice putting or visit with friends. A highlight on his 70th birthday came when his golf score equaled his age.
He was preceded in death by his wife, who died on November 26, 1999; two brothers George and Gene Denton; and two sisters, Mrs. Dorothy Kidwell and Mrs. Rosaleen Jett.
Survivors include one daughter, Marjorie, a son-in-law, David, and grandson, Matthew Lowell Rankin Winfough, all of Cincinnati; one sister, Mrs. Barbara Ann Sorrell, of Hillsboro; several nieces and nephews; and his friend and companion, Mrs. Ausel Eubanks.
Funeral services will be at 11 a.m., Tuesday, Oct. 21, 2008 at the Denton-Workman Funeral Home with Rev. Norman Wasson and Bro. Lynn Beach officiating. Burial will follow at the Fleming County Cemetery. Visitation 6 p.m., Monday, Oct. 20 at the funeral home.

Pollard found guilty

A Fleming County jury returned a guilty verdict in a wanton endangerment case against a man also charged with murder.

Roy I. Pollard Jr. was found guilty of wanton endangerment, terroristic threatening and violating an EPO. The charges stem from an encounter with Eric Thompson, the brother of Jason Thompson, who was shot to death in January. Pollard has been charged with that murder and that of Willa Thompson, who was killed the same night.

According to Eric Thompson, Pollard came to the Thompson residence in December and pulled a gun on Thompson.
